But the pertinent laws, regarding the Virginia counties in this work, governed persons of color who were born free, or emancipated by deed or will.\u003c\/p\u003e\n\u003cp\u003eIn 1793, the Virginia Assembly passed legislation requiring all incorporated cities in the Commonwealth to register free persons of color. The law was expanded in 1803 to include all Virginia counties. And in 1806 a more draconian law was implemented which declared that all formerly enslaved persons freed after 1 May 1806 would be required to leave the Commonwealth after attaining the age of 21. Despite this edict, most did not leave and the courts of the various counties tended to overlook that provision of the 1806 law.\u003c\/p\u003e\n\u003cp\u003eThose considered persons of color included negroes, Indians, and mixed race individuals. These registrations included the person’s name, age, sex, height, complexion, how they were freed, and a detailed description of distinguishing scars or marks anywhere on the person’s body. The individual so registered was obligated to have the original copy sheet readily available for inspection—either on his or her person or easily and quickly produced.\u003c\/p\u003e\n\u003cp\u003eThe Virginia counties, now in West Virginia and established prior to 1863, were obligated to follow the same laws as all other Virginia counties regarding the registration of free persons of color. After the close of the Civil War, many Virginia and West Virginia counties discarded the registers of free persons of color because they were no longer relevant or useful.\u003c\/p\u003e\n\u003cp\u003eThe transcribed register records herein include Greenbrier County (1846–1864), Kanawha County (1829–1847), Mason County (1838–1860), Pendleton County (1839–1859), and Putnam County (1845–1860).
